Terms of Service

These Terms of Service (“Terms”) are a legal agreement between you and Transatlantic Candy LLC, a Florida limited liability company doing business as Pim’s Pick ‘N’ Mix (“Pim’s,” “we,” “us,” or “our”). By accessing or using pimspicknmix.com(the “Site”) or placing an order, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.

You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order. By using the Site, you represent that you meet this requirement and that the information you provide is accurate.

You may be required to create an account to make a purchase. You are responsible for keeping your login credentials confidential and for any activity that occurs under your account. Notify us immediately if you suspect unauthorized access.

All orders placed through the Site are offers to purchase, subject to our acceptance. We reserve the right to refuse or cancel any order at our discretion, including for suspected fraud, pricing errors, or product unavailability. If we cancel an order after payment, we will issue a full refund.

Product images are for illustration. Actual candy color, shape, and packaging may vary slightly between batches.

All prices are listed in U.S. dollars and exclude shipping and applicable taxes, which are calculated at checkout. We reserve the right to change prices at any time before you complete a purchase.

Payment is processed by Shopify Payments. By submitting payment, you authorize us (and our payment processor) to charge your payment method for the order total.

We ship to addresses within the United States. Shipping options, costs, and estimated delivery times are shown at checkout. Title and risk of loss pass to you when the carrier accepts the package.

All sales are final. Because our products are perishable food items, we do not accept returns or exchanges.

If your order arrives damaged, incorrect, or defective, contact us at hello@pimspicknmix.com within 7 days of delivery and we will make it right (replacement or refund). Photos of the damaged product and packaging are required.

The Site and all of its contents , including logos, photos, text, graphics, video, packaging design, and the Pim’s brand , are the property of Transatlantic Candy LLC or our licensors and are protected by U.S. and international intellectual property laws. You may not copy, modify, distribute, sell, or commercially exploit any part of the Site without our prior written permission.

If you submit reviews, photos, comments, or other content to the Site or to our social channels in connection with the Site, you grant Pim’s a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, and display that content in connection with our marketing and operations. You represent that you own the content or have permission to grant this license.

You agree not to:

• Use the Site for any unlawful purpose.
• Attempt to gain unauthorized access to our systems.
• Use automated tools (bots, scrapers) to access the Site without permission.
• Resell or repackage Pim’s products without a written agreement.
• Misrepresent your identity or impersonate another person.
• Interfere with the operation of the Site or other users’ experience.

THE SITE AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, EXCEPT AS REQUIRED BY LAW. Some jurisdictions do not allow the exclusion of implied warranties, so this exclusion may not apply to you.

Allergens: our products may contain or come into contact with milk, eggs, fish, shellfish, tree nuts, peanuts, wheat, soy, and sesame. Always check the allergen information on each product page. We are not responsible for adverse reactions resulting from undisclosed allergies.

TO THE FULLEST EXTENT PERMITTED BY LAW, PIM’S AND ITS OWNERS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, OR DATA, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR ANY PRODUCT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability for any claim arising out of or relating to these Terms or your use of the Site will not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

You agree to indemnify, defend, and hold harmless Pim’s and its owners, employees, and affiliates from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or your misuse of the Site or our products.

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. The exclusive venue for any in-court dispute (subject to the arbitration provision below) is the state or federal courts located in Palm Beach County, Florida.

We hope to resolve any disagreement informally. Before filing a claim, please contact us at hello@pimspicknmix.com and give us 30 days to respond.

If we cannot resolve a dispute informally, you and Pim’s agree that any claim arising out of or relating to these Terms or your use of the Site will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, in Palm Beach County, Florida. You waive the right to a jury trial and the right to participate in a class action.

Notwithstanding the above, either party may bring an individual claim in small claims court for disputes within that court’s jurisdiction.

We may update these Terms from time to time. The current version will always be posted on this page with the “Last updated” date. Continued use of the Site after changes constitutes acceptance of the updated Terms.
